NSAB 2015
1.1 The General Conditions of the Nordic Association of Freight Forwarders (NSAB 2015) apply for all services offered by KTM shipping AS (the freight forwarder) to a customer, unless the freight forwarder has specifically confirmed otherwise in writing.
1.2 All references in this document starting with the section sign (§) is a reference to such numbered section in NSAB 2015.
Exclusion
2.1 §25A, second section is excluded. The freight forwarder will only take out said insurance if specifically agreed in writing.
2.2 Any limit of liability described in bills of ladings and/or ship owners individual charter-party requirements, or corresponding is applicable in addition to those described in NSAB 2015 if referred to or provided.
Insurance
3.1 Insurance of the cargo (whether during transport or storage) is not included and will only be provided upon specific request.
3.2 It is recommended that the customer arrange its own insurance, especially in order to be protected in case of general average situations, cf. § 26 last section.
The freight forwarder's liability
4.1 As contracting party, cf. § 3 B, the freight forwarder’s liability for loss of, deterioration of, or damage to goods is limited to SDR 8.33 per kilo, and for delay to the amount of the freight, and for all other loss to SDR 100,000 in respect of each assignment, cf. § 21. As intermediary, cf. § 3 C, the freight forwarder’s liability is limited to SDR 50,000 in respect of each assignment, and totally in the event of any one occurrence to SDR 500,000, cf. § 24. For storage, the total liability is limited to SDR 500,000 for damage occurring on the same occasion, cf. § 25.
4.2 Please be aware of the network clause, cf. § 2.
Confidentiality
5.1 All prices and information confidential, cf. § 13. prices and information from the freight forwarder to a customer or potential customer is given only for such customer or potential customer 5.2 The receiver of such information must treat all the freight forwarder’s given prices and information confidential, cf. § 13.
Questions and prices
6.1 The quoted price does not include VAT, cost for customs documents and formalities unless specifically mentioned, brokerage, anchorage dues, fees, duties, local taxes, demurrage, detention and other possible third party charges.
6.2 The quoted price is applicable for transport via the ports or transportation method specified in the quotation and is subject to acceptance within the given time, vessel space, equipment availability and approval of storage.
6.3 If not accepted within the given time, being one week unless otherwise specified, the freight forwarder has the right to re-quote if necessary.
6.4 All booking schedules/plans given with dates inserted are estimates only and therefore without guarantee.
6.5 Please note that carrier, vessel, routings, transhipment ports, frequency and transit times mentioned in the original offer is subject to changes until final booking confirmation is given.
6.6 The freight forwarder reserves the right to adjust the given price and rates in case of fluctuations in currency exchange rates, fuel prices or third party charges.
